WARRANTY AND INDEMNIFICATION

Intended Use and Service

Ready Set Inc. (the "Company") has developed an estimate outlining the necessary materials and construction methods for the Client's product, based on the Client's communicated intended use and service.

By accepting the estimate and agreeing to the payment terms, the Client acknowledges and accepts the specified limitations regarding the product's intended use and service. The Client will be held liable for any use or service that exceeds the scope presented during the estimation phase.

Considerations for intended use and service include, but are not limited to: weight-bearing capacity, exposure to environmental elements, and interactions by parties other than the Company and the Client.

WARRANTY

Ready Set Inc. warrants all products it fabricates and installs to be free from defects in workmanship and materials for the use and service for which the product is intended.

The Company's warranty and liability are limited to defects occurring within the scope of intended use and service, specifically covering:

  • Defects in materials used to manufacture the product.

  • Defects arising from workmanship, fabrication, or installation.

  • Components broken or non functioning prior to or during installation.

Should a defect be found under warranty, the Company will coordinate with the Client to repair, replace, or alter the product to the standard set forth in the estimate.

This Warranty does not cover any Product defect or claim arising from:

  • Any usage beyond the intended use and service.

  • Any unauthorized modification to the product by any party other than the Company.

  • Damage to the product resulting from negligence.

  • Damage caused by natural disaster.

  • Theft or loss of the product.

Expendable items such as fluorescent tubes, filters, bulbs, and disposables are excluded from this warranty. Any non-covered product may be repaired by the Company upon execution of a new estimate and agreement.

INDEMNIFICATION

To the fullest extent permitted by law, the Client shall indemnify and hold harmless Ready Set, Inc., its subsidiaries and affiliates, officers, directors, agents, representatives, and employees, its landlord and/or sub-landlord at each of its locations, and the owner of the real property at each such location, against any claims, damages, losses, and expenses, including reasonable legal fees, arising out of or resulting from:

A) Excessive Use and Service, defined as:

  • Any use which exceeds the "Project Dates" as shown on the job Terms and Conditions documents.

  • Any use which does not comply with the intended design.

  • Any use which exceeds expected "Intended Use" as defined herein.

  • Any other use which Ready Set Inc. advises is prohibited.

B) Any modifications made by the Client or third parties to the installed product without the input or participation of Ready Set Inc.

Term of Agreement

The initial term of this Agreement is limited to 30 days from the completed delivery as noted on the job documents or upon the de-installation of the product, whichever occurs first. Upon expiration of the initial term, this Agreement may be renewed by mutual agreement, signed by both parties.
